privacy policy

We like plain English. Some sections of this Privacy Policy start with a box (like this!) that summarizes parts of the legal stuff in plain English. We hope you find those helpful, but make sure to read the entire document because the legal stuff is important too. If you think there’s any difference between the summaries in these boxes and the rest of the document, the language outside of the boxes is what will govern.

Plain English: If you use either our Apple or Google mobile apps or use our website, this Privacy Policy explains how we use PII about you that we receive. It doesn’t cover information that we may gather about you in other ways. “PII” is information that we collect from you or from others about you that could identify you.

This Privacy Policy (“Policy”) describes the ways that Pronounced [Human], LLC, a Maine limited liability company (“we” or “us”), collects, uses and shares about you when you use either of the Transcapsule mobile applications published in the Apple or Google platforms (Apple’s App Store or Google Play) or the Transcapsule website (www.transcapsule.com). Together, this Policy refers to the mobile applications and website as the “Service.” This Policy applies to personally identifiable information that we collect from you and from third parties about you (together, “PII”), and it applies to PII that we collect through the Service and in any emails, text messages or other electronic messages that you may choose to send to us you and us.

This Policy does not apply to PII that:

  • we collect in ways other than through the Service, including on any other website that we or a third party operate; or
  • any third party may collect, including through any application or content (including advertising) that may link to or be accessible via the Service.

Plain English: You’re agreeing to this Privacy Policy as it reads now as well as in ways that we might update it later.

By visiting, accessing, using or downloading the Service or creating an account with the Service, you agree to our use of PII in the ways that this Policy describes. This Policy may change from time to time, and your continued use of the Service after any changes we may make to the Policy will be deemed to be your acceptance of those changes, so please check the Policy periodically for updates. Your continued use of the Service after any modification means that you acknowledge the change and agree to the practices that we disclose in the Policy.

PII That You Provide Us

Plain English: Here’s a summary of the types of PII that you might give us.

The PII that we collect on or through our Service may include:

  • Information that you enter into forms in the Service or in Third-Party Services (like Mailchimp, which we use to gather your contact information). This includes information provided at the time of downloading or using the Transcapsule mobile applications.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.
  • Details of transactions you carry out through our Service and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Service.

In these ways, we may ask you for your name, phone number, photo(s), email address, mailing address and information about how you have used the Service. We may also give you the option to provide payment information to Third-Party Services that we use to collect payments.

PII That We Collect Through Automatic Data Collection Technologies

Plain English: Here’s a summary of the types of PII that we might receive about you without your manually providing it to us, including cookies.

As you use the Service, we may use automatic data collection technologies to collect information about your equipment and browsing actions. These may include:

  • Details of your visits to and usage of the Service, including traffic data, location data, logs, and the resources that you access and use on the Service.
  • Information about your computer or mobile device and Internet connection, including your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking).

We collect this information to help us understand how people use the Service, how we can improve its speed, how we can make it easier for people to use it and in some cases to advertise the Service or other products that we offer.

The technologies we use for automatic data collection may include cookies. A cookie is a small file placed on the hard drive of your computer or mobile device. You may refuse to accept cookies by activating the appropriate setting on your browser, but doing so may make you unable to access certain parts of the Service. Unless you have adjusted your browser setting to refuse cookies, our system will issue cookies when you visit the Service. Third-Party Services (including Facebook) may use cookies in connection with your use of the Service as well.

You may opt out of our use of these tools with you, and you can learn more about how to do so at the Digital Advertising Alliance’s Webchoices page, European Advertising Standards Alliance (EASA)’s Framework and the Network Advertising Initiative’s Consumer Opt Out page.

How We Use Your Information

Plain English: Here’s how we use PII that we receive about you.

We use PII to:

  • provide the Service to you.
  • provide you with information, products, or services that you request from us.
  • let you know about changes to our Service or any products or services we offer or provide though the Service.
  • carry out our obligations and enforce our rights arising from any contracts that you enter into with us, including for billing and collection.
  • create and use Anonymized PII in the ways this Policy explains.
  • fulfill any other purpose for which you provide it.

If we use your email address to communicate with you (with the exception of transactional emails regarding your use of the Service), we will provide you with the option to unsubscribe or opt out of future emails.

How We Disclose PII to Third Parties

Plain English: Here’s how we share PII about you with certain types of third parties.

We may disclose aggregated, anonymized information about our users (that is, information that relates to users but only without disclosing their identities or the unique identities of their mobile devices or computers, and without disclosing any other individual PII) (“Anonymized PII”) without restriction or notification.

We will not sell, rent, license or disclose your PII to third parties except:

  • to work with third-party companies that we use to provide, improve or market the Service or other products that we offer (“Third-Party Services,” below).
  • where we believe it is necessary to respond to legal claims asserted against us, to comply with legal process (e.g. warrants and subpoenas), to enforce or administer our agreements, to prevent fraud, for risk assessment, for investigation, and to protect the rights, property or safety of us, our users or others. This may include exchanging information with other organizations for fraud protection and credit risk reduction purposes.
  • to share Anonymized PII with our Trans Health Research Collective as part of the voluntary, opt-in Trans Health Research Collective Program, should you choose to participate in that Program (see below).
  • to investigate suspected violations of our Mobile Application Terms of Use.
  • to subsidiaries or affiliates that we may have today or in the future.
  • to a buyer or other successor in the case of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which the transferred assets include PII that we maintain about the people who use our Service.
  • to enforce or apply our Mobile Application Terms of Use or other agreements that we may have with you, including billing and collection purposes.
  • with your consent.
  • to fulfill the purpose for which you provide it.
    If we share PII relating to you with any third party (aside from the Third-Party Services mentioned in this Policy), we will share that PII in anonymized form.

Third-Party Services

Plain English: Here’s information about some of the third parties that we use to make the Service that you’re using.

We use various Third-Party Services to operate the Service. These include: Amazon Web Services, Facebook’s Pixel, Google AdWords, Google Analytics, Mailchimp, Square and Typeform, and they may include others in the future.

Third-Party Services collect, use and share PII pursuant to their own privacy and security policies. Some of them, including Google, may use location information and other PII to serve advertisements to consumers on other websites. By using our Service, you consent to our providing PII with Third-Party Services to be used in accordance with their own privacy and security policies as they exist today and as they may change in the future.

Trans Health Research Collective Program

Plain English: We work with a collective of people who research Trans Health issues, and sometimes we share with them Anonymized PII about our users who have chosen to opt in to this program. Here’s info about that program and how you can opt in and later opt out.

We may offer you, through a separate written document or screen in the Service, the option to participate in our Trans Health Research Collective Program (“Program”). This Program is voluntary and does not require your participation in order for you to use the Service. Our Trans Health Research Collective is a group of health professionals (including our own employees or owners as well as health professionals from research universities and other organizations) who review Anonymized PII relating to people who use the Service for research purposes. Collective members may change from time to time. As explained above, “Anonymized PII” is information that relates to users of the Service but does not identify them individually. Collective members will therefore see large sets of general data involving those Transcapsule users who opted into the Program but without any way to learn any individual’s identity.

If you choose to participate in the Program, then Anonymized PII relating to you will be shared with the Trans Health Research Collective. Individual Collective members have access to this data, but they are contractually obligated not to share it with the research institutions with which they work or with other third parties. You can opt out of the Program any time you like, by using the features you will see in the Service interface itself, but please be aware that once Anonymized PII relating to you has been shared with the Collective, it is not withdrawn later if you opt out.

Data Security; Disclaimer of Warranties

Plain English: We try to keep PII secure. But on the Internet, nobody can really guarantee nothing will ever be hacked or disclosed inadvertently, so we don’t guarantee that. And you agree not to sue us if third parties use or access your PII in a way that we don’t allow.

We use reasonable efforts to protect your PII from unauthorized access, but we cannot and do not warrant or promise that it will be free from unauthorized access by third parties such as hackers.

WE MAKE NO REPRESENTATIONS, WARRANTIES OR PROMISES ABOUT THE SECURITY OF PII EXCEPT AS STATED EXPRESSLY IN THIS POLICY OR WHERE REQUIRED BY LAW.

BY USING THE SERVICE, YOU (A) CONSENT TO OUR USING YOUR PII AS DESCRIBED IN THIS POLICY DESPITE THIS RISK; (B) WAIVE ANY CLAIMS AGAINST US OR ANY PARENT, SUBSIDIARY OR AFFILIATE COMPANY THAT WE HAVE OR MAY HAVE IN THE FUTURE RELATING TO THE INTERCEPTION, USE OR DISCLOSURE OF YOUR PII BY THIRD PARTIES UNAUTHORIZED BY US; AND (C) AGREE TO NOTIFY US PROMPTLY IF YOU SUSPECT ANY UNAUTHORIZED USAGE OF PII.

Children

Plain English: To use the Service, you need to be over 18 (or 13-18, with permission of your parent or guardian).

To access or use the Service, you must either (a) be at least 18 years old and have the requisite power and authority to understand and consent to the practices described in this Policy or (b) be at least 13 years old and be using the Service with the permission of your adult parent or legal guardian who has reviewed this Policy with you and consented to our use of PII relating to you in the ways that this Policy describes. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Service or provide any information about yourself to us.

Your Rights with Respect to PII

To update, edit or delete the PII that we keep, you may simply use the tools provided in the mobile application interface.

Data Retention and Deletion

We generally retain your PII for as long as you continue to use the Service or as needed to continue providing the Service to you. If you delete your account, we will delete your PII but Third-Party Services or other third parties with whom we have already shared your PII as described in this Policy may not necessarily do so. If at any time before deleting your account you opt in to our Trans Health Research Collective Program (described above), then deleting your account does not delete any Anonymized PII that we may have already shared with the Collective during the period in which you participated in the Program.

“Do Not Track” Technology

Plain English: You can use “Do-Not-Track” tools with our Service, but they generally won’t change the way our Service works.

If you use Do-Not-Track tools to prevent websites and software products from tracking your online behavior across websites, please be aware that we do not change the way the Service works (as described in this Policy) in response to requests not to be tracked. You may, however, be able to disable certain tracking signals used by individual Third-Party Services, which you may do by accessing those services.

No Rights of Third Parties

This Policy does not create rights enforceable by third parties, nor does it require disclosure of any information relating to users of the Service.
